The Report of the Portfolio Holder for Regulatory and Community Safety sought Council approval and adoption of Tamworth’s Statement of Licensing Policy 2020-2023 and Cumulative Impact Assessment 2020 – 2023 under the Licensing Act 2003.

 

RESOLVED

 

 

1.    Council approved and adopted the final amended version of Tamworth's Statement of Licensing Policy 2020 – 2023 and Cumulative Impact Assessment 2020 – 2023

 

2.    To undertake an initial review by Tamworth Borough Council Officers, as soon as possible, of the cumulative impact assessment, within the guidelines of policy.

The Report of the Portfolio Holder for Regulatory and Community Safety was presented to inform Cabinet of the outcome of consultations regarding the review of Tamworth's statement of licensing policy and proposed cumulative impact assessment and to request Cabinet to consider and approve the revised policy and cumulative impact assessment.

 

RESOLVED

That Cabinet:

 

 

Considered and endorsed the final amended version of Tamworth's Statement of Licensing Policy and the proposed Cumulative Impact Assessment

 

 

Referred the revised Statement of Licensing Policy and Cumulative Impact Assessment to Council for approval and adoption

 

Recommended that an initial review by Tamworth Borough Council Officers, as soon as possible, of the cumulative impact assessment within the guidelines of policy be undertaken.

To consider the Report of the Assistant Director Growth and Regeneration to the Licensing Committee.

The Report to the Licensing Committee of the Assistant Director, Growth and Regeneration on the Adoption of the Proposed Licensing Policy 2020-2023 was presented by the Environmental Health Officer.

 

The Report advised the Licensing Committee of the outcome of the consultations regarding the review of Tamworth’s statement of licensing policy and proposed cumulative impact assessment and provided Members with an opportunity to consider the revised policy and cumulative impact assessment before its consideration by Cabinet and Council.

 

The Committee was updated on the amendments suggested by the Licensing Committee including the additional recommendation made by that Committee and to be considered by Cabinet and Council.

 

The Committee discussed aspects of the proposed policy, in particular the role of the cumulative impact assessment to guide the Council when in receipt of new applications.  It was reported that there would be rebuttable presumptions that new applications would normally be refused if representations about cumulative impact on licensing objectives were received, unless it could be demonstrated that the operation of the premises involved would not add to the cumulative impact already being experienced. 

 

The Committee also discussed the interaction of this policy with the Gambling Policy, and in particular how the law applied to less than 3 gambling machines in licensed premises.

 

RESOLVED that the Committee supported the Report with the suggested amendments.

The Assistant Director, Growth and Regeneration advised Licensing Committee of the outcome of consultations regarding the review of Tamworth's statement of licensing policy and proposed cumulative impact assessment.

 

Members considered and debated the revised policy and cumulative impact assessment

 

RESOLVED

That Committee;

 

 

 

Recommended that the following amendments be made to the report:

1.    At Appendix 2, include the Staffordshire Police consultation response;

2.    At Appendix 3, remove all references to paragraph 14.5 in the table;

3.    At Appendix 3, to insert “The requirements are that:” at page 10;

4.    Include an additional recommendation in the report to:

Review as soon as possible the cumulative impact assessment within the guidelines of the policy.

 

 

Considered and endorsed the final amended              version of Tamworth's Statement of Licensing Policy and the proposed Cumulative Impact Assessment, and

 

 

Referred the revised Statement of Licensing Policy and Cumulative Impact Assessment to Cabinet and Council for approval and adoption.
